Welcome to the stack app. These Terms of Service ("Terms") govern your use of our mobile application and website (the "Service"). By using the stack app, you agree to these Terms. Please read them carefully.
Acceptance of Terms
By creating an account or using the stack app, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Service.
You must be at least 13 years old to use the stack app. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
Your Account
To use the stack app, you need to create an account using your phone number. You are responsible for:
- Keeping your account secure and not sharing access with others
- All activity that happens under your account
- Providing accurate information when creating your account
- Notifying us immediately if you believe your account has been compromised
You may only have one account. We may suspend or terminate accounts that appear to be duplicates or are being used to circumvent our rules.
Your Content
You own your content. When you create stacks, add items, upload photos, or write descriptions, you retain ownership of that content. We do not claim ownership over anything you create.
By posting content on the stack app, you grant us a license to:
- Display your content to other users of the Service
- Store and backup your content on our servers
- Process your content using AI to help with item enrichment
- Use your public stacks in promotional materials (we will credit you)
This license ends when you delete your content or your account, except for content that has been shared by others or contributed to the public item library.
Prohibited Content and Behavior
We want the stack app to be a positive space for everyone. You agree not to:
- Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or hateful
- Upload photos that you do not have the right to use
- Impersonate others or create fake accounts
- Spam, advertise, or promote products or services without permission
- Post content that infringes on intellectual property rights
- Use the Service to stalk, bully, or harm others
- Share content that is sexually explicit or exploitative
- Encourage illegal activities or violence
We may remove content that violates these rules and suspend or ban accounts that repeatedly violate them.
Prohibited Technical Actions
You agree not to:
- Use bots, scrapers, or automated tools to access the Service without permission
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the Service or its servers
- Reverse engineer, decompile, or attempt to extract the source code of our app
- Circumvent any security measures or rate limits
- Use the Service in any way that could damage or overburden our infrastructure
Product Information and Links
the stack app displays information about products, including names, prices, and purchase links. Please understand that:
- We are not a store and do not sell products directly
- Product information is provided by users and automated systems, and may not always be accurate
- Prices and availability may change without notice
- We are not responsible for transactions you make with third-party retailers
- External links are provided for convenience and we do not endorse those websites
Intellectual Property
the stack app and its original content (excluding user-generated content), features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.
"the stack app" name, logo, and related branding are our trademarks. You may not use them without our written permission, except to refer to our Service.
Copyright and DMCA
We respect intellectual property rights. If you believe content on the stack app infringes your copyright, please contact us at willsepesi@gmail.com with:
- A description of the copyrighted work you claim has been infringed
- The URL or location of the infringing content on the stack app
- Your contact information
- A statement that you have a good faith belief that the use is not authorized
- A statement that the information in your notice is accurate, under penalty of perjury
Termination
You can delete your account at any time through the app settings. When you delete your account:
- Your profile, stacks, and personal items will be deleted
- Content you contributed to the public item library may remain
- Your data will be deleted within 30 days (some may be kept longer for legal reasons)
We may suspend or terminate your account if you violate these Terms, at our sole discretion. We will try to give you notice when possible, but may act immediately for serious violations.
Disclaimers
the stack app is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:
- The Service will be uninterrupted, secure, or error-free
- Product information will be accurate or up-to-date
- Content posted by users will be accurate, legal, or appropriate
- The Service will meet your specific requirements
Limitation of Liability
To the maximum extent permitted by law, the stack app and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, data, or goodwill
- Service interruption or loss of access
- Actions of other users
- Any purchases you make based on information in the Service
- Any bugs, viruses, or other harmful code
Our total liability for any claims under these Terms shall not exceed the amount you paid us (if any) in the 12 months before the claim arose.
Indemnification

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any legal action must be brought in the courts located in San Francisco, California.

- These Terms constitute the entire agreement between you and the stack app
- If any part of these Terms is found to be unenforceable, the rest remains in effect
- Our failure to enforce any right or provision does not waive that right
- You may not assign or transfer your rights under these Terms without our consent
